License Agreement / Terms of Usage

By purchasing and downloading digital 3D city models ("Models") from CITYFRAMES GmbH, the legal entity operating under the brand 3DCityModel.com, you ("User") expressly agree to be bound by the following terms and conditions ("Agreement"):
§ 1. Definitions
For clarity within this Agreement, the following terms are defined:
- Models: Digital 3D city model files in STL format provided by 3DCityModel.com.
- User: The individual purchaser identified by the billing information provided at the time of purchase.
- Non-commercial Use: Any use solely for private purposes without monetary gain or commercial benefit.
- Commercial Use: Use that directly or indirectly generates revenue, business promotion, or profit.
- Derivative Works: Any works created by modifying, adapting, or significantly transforming the Models.
§ 2. License Scope
This license grants the User rights strictly under these conditions:
- Non-commercial: Usage exclusively for personal, non-commercial purposes.
- Single-user: Rights are exclusively granted to the purchaser.
- Personal-use copies: The User may produce a reasonable number of physical copies of each purchased Model for personal use only (e.g. for display in different rooms or as a gift to close friends or family). Mass production or distribution, even without profit, is not permitted without explicit permission.

§ 3. Intellectual Property & Attribution
3DCityModel.com retains all intellectual property rights, including copyright, trademarks, and related rights.
User receives solely the right for personal, non-commercial usage through 3D printing.
No attribution is required for permitted personal use.
§ 4. Permitted and Prohibited Uses
Permitted Uses:
The User may utilize the Model solely for: Personal projects (souvenirs, gifts, home decor, personal collections). Modifications such as scaling, cutting, or adapting are permitted only for personal, non-commercial purposes. Modified versions remain subject to all restrictions in this Agreement.
Prohibited Uses:
All uses other than explicitly permitted under Section "Permitted Uses" are strictly prohibited. Specifically, the User must not:
- Resell, redistribute, or sublicense the Model in any form.
- Host publicly or make the Model available for download or sharing in any digital or physical form.
- Use or modify the Model for commercial purposes without prior explicit consent.
- Create derivative works from the base Model for resale, distribution, or commercial use.
- Claim ownership or falsely imply ownership of intellectual property rights over the Model.
§ 5. Accuracy and Warranties
Models are provided digitally in STL format (or other formats as made available by 3DCityModel.com) without warranties regarding completeness, accuracy, or exact representation of real-world structures.
Models are artistic interpretations and may differ from actual buildings or cities.
3DCityModel.com explicitly disclaims all warranties of merchantability and fitness for a particular purpose.
§ 6. Liability, Indemnification, and Proof of License
Models are provided “as is” without warranties regarding completeness, accuracy, or exact representation of real-world structures. They are artistic interpretations and may differ from actual buildings or cities.
3DCityModel.com explicitly disclaims all warranties of merchantability and fitness for a particular purpose.
3DCityModel.com is not liable for any indirect, incidental, consequential, or special damages arising from the User’s use, misuse, or inability to use the Models, even if advised of the possibility of such damages.
The User agrees to indemnify, defend, and hold harmless 3DCityModel.com and CITYFRAMES GmbH from any and all claims, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising from:
- the User’s unauthorized or improper use of the Models,
- any violation of this Agreement,
- or any infringement of third-party rights resulting from the User’s activities.
The invoice or download receipt shall serve as proof of license and usage rights for the respective Model, solely for personal, non-commercial use.
§ 7. Transferability and Refund Policy
Licenses and downloaded Models are strictly non-transferable.
Once the file is accessed, downloaded, or viewed, the purchase is considered final and non-refundable.
§ 8. License Termination and Penalties
3DCityModel.com reserves the right to immediately terminate the User’s license upon breach of any terms within this Agreement.
Upon termination, the User must immediately cease use and permanently delete all copies of the Models.
Violations, especially unauthorized resale, redistribution, or commercial use, will result in termination and entitle 3DCityModel.com to seek immediate legal remedies, including a penalty of at least €2,500 per incident, without prejudice to claims for additional damages.
§ 9. Amendments
3DCityModel.com reserves the right to amend or update this Agreement for future purchases. Updated terms will apply only to purchases made after such amendments.
§ 10. Severability
Should any provision of this Agreement be declared invalid or unenforceable, remaining provisions remain fully effective and enforceable.
§ 11. Entire Agreement
This document constitutes the complete and exclusive terms governing usage rights for purchased Models, superseding all prior discussions, negotiations, or agreements.
§ 12. Applicable Law and Jurisdiction
This Agreement is governed exclusively by the laws of the Federal Republic of Germany.
All disputes arising under or related to this Agreement will be subject to the jurisdiction of competent courts in Frankfurt am Main, Germany.
